It is jointly submitted by learned counsels appearing for the petitioners that the subject matter of the instant application being directly in issue, this case was directed to be listed after disposal of L.P.A. no.1438 of 2013 (Bhola Prasad Singh versus State of Bihar and Ors.) which has since been dismissed by the learned Division Bench by order dated 29.1.2015.

Learned counsels submit that the facts of the instant case is squarely covered by the judgment of the learned Division Bench in the aforesaid L.P.A. no.1438 of 2013 (Bhola Prasad Singh versus State of Bihar and Ors.) and can be disposed of in similar terms.
