None ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-01-2021 Heard learned counsel appearing on behalf of the petitioner. No one appears on behalf of the State although the name of the Advocate General appears in the cause list. The petitioner is in custody in connection with Excise Case No. 436 of 2019, arising out of Chewara P.S. Case No. 81 of 2019, for the offence under Sections 272 and 273 of the Indian Penal Code and Sections 30(a) and 30(d) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that in the instant case only 2 litres of country made liquor was seized. Learned counsel submits that the petitioner has been falsely implicated and there is no material against the petitioner that he was involved in trade of liquor. Petitioner is in custody since 14.08.2020.

The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge II, Sheikhpura in connection with Excise Case No. 436 of 2019 arising out of Chewara P.S.
