JUSTICE SANDEEP KUMAR ORAL ORDER 23-05-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioners seek regular bail in connection with G.R. No. 472 of 2023 arising out of N.T.P.C. Khaira P. S. Case No. 45 of 2023 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioners submits that the there is recovery of 302.4 litres of illicit country-made liquor from the vehicle in question and also the petitioner is in custody since 08.04.2023. The petitioners have no criminal antecedent.

Patna High Court CR. MISC. No.32724 of 2023(2) dt.23-05-2023 2/2 Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioners, their period of custody and their clean antecedent, this application is allowed.

Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court Special Judge of Excise- 2nd Aurangabad in connection with G.R. No. 472 of 2023 arising out of N.T.P.C. Khaira P. S. Case No. 45 of 2023.
