JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-09-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Danapur P.S. Case No. 636 of 2018, registered for the offences punishable under Sections 147, 148, 149, and 302 of the Indian Penal Code and section 27 of the Arms Act.

Allegation against all the accused persons including this petitioner is that they committed murder of informant's brother by making firing.

It is submitted on behalf of the petitioner that there is specific allegation against co-accused Nikhil Rajak that it was Nikhil Rajak who opened fire upon the deceased. There is general and omnibus allegation against this petitioner. Coaccused Bittu Rai @ Bittu Kumar @ Avinash Kumar has been granted bail by a Coordinate Bench of this court vide order

Patna High Court CR. MISC. No.30412 of 2019(4) dt.18-09-2019 2/2 dated 05.02.2019 passed in Cr. Misc. No. 6342 of 2019. Petitioner is in custody since 05.10.2018.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Danapur, Patna in connection with Danapur P.S. Case No. 636 of 2018.
