The petitioner is in custody in connection with Garkha P.S. Case No. 237 of 2020 for the offence under Sections 399, 402, 413, 414, 420, 468/34 of the Indian Penal Code and Sections 25(1-b) a/26/35 of the Arms Act.
In the present case, the police received secret information that some miscreants assembled at Bhaismara Brick-kiln for committing loot. Thereafter, the police party reached there and miscreants were arrested from there and from the possession of petitioner Hero Honda Splender motorcycle was recovered.
Patna High Court CR. MISC. No.30989 of 2020(2) dt.08-01-2021 2/2 Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 05.06.2020. He further submits that nothing incriminating was recovered from the possession of the petitioner. Considering the fact that the petitioner has got no criminal antecedent and he has remained in custody for more than seven months, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Garkha P.S.
