Mr. Braj Kishore Prasad, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 24-01-2022 Heard learned counsel for the petitioner and Shri Braj Kishore Prasad, learned A.P.P. for the State through virtual court proceedings.

The petitioner seeks bail in connection with Sohsarai P.S. Case No. 190 of 2020 instituted for the offences under Section 394 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 05.12.2020, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of causing hurt to the informant while committing robbery of ornaments, T.V., mobile and Rs. 50,000/- in his house.

Learned counsel for the petitioner submits that during

Patna High Court CR. MISC. No.41519 of 2021(2) dt.24-01-2022 2/2 the T.I. parade the petitioner was not identified by the informant and his wife and that in itself shows that the petitioner has been falsely implicated in the case while the other accused were identified.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 05.12.2020, charge-sheet has been submitted in the case, the petitioner is a person with clean antecedent and he was not identified during the T.I. parade, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Sohsarai in connection with Sohsarai P.S. Case No. 190 of 2020 with a condition that one of the bailors shall be the father of the petitioner.
