On 25.07.2014 in the present proceeding, the Court noted the defiance of the Presiding Officer, District Teacher Employment Appellate Tribunal, Katihar and asked for explanation fixing 28.07.2014, as the date in the writ application.

On 12.10.2018, this Court noticing the continuing

Patna High Court CWJC No.1724 of 2013(7) dt.05-08-2019 2/3 defiance of the District Teacher Employment Appellate Tribunal, Katihar, the Court directed the Presiding Officer of the Appellate Tribunal to file show-cause as to why not contempt proceeding be initiated against him for defying the order of this Court dated 25.07.2014.

Despite specific direction issued by this Court on 12.10.2018, there was no compliance, the Court restrained the Presiding Officer, District Teacher Employment Appellate Tribunal, Katihar not to pass any order in any of the cases pending before the Tribunal until further orders passed by this Court.

It is now submitted at the bar that the then Presiding Officer demited the post. Under the aforesaid circumstance, the writ application is disposed of with a direction to the successor Presiding Officer, District Teacher Employment Appellate Tribunal, Katihar to pass appropriate order with regard to pending Misc. Case No. 2017 of 2010 and Misc. Case No. 2042 of 2010 at the earliest preferably within a period of 45 days from the date of receipt/production of a copy of this order. The Appellate Tribunal may consider and pass appropriate order on the application filed by the parties in addition to the aforesaid pending Misc. cases.
