The petitioner seeks bail in a case instituted for the offences under Sections 25(1-A), 25(1-AA), 25(1-B)AC, 26(i) (ii) (iii) and 35 of the Arms Act.

The prosecution case in short is that while the informant along with police party was on patrolling duty, on hearing sound of firing, when they reached place of occurrence, the accused persons started fleeing away but one of them was apprehended.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 6.2.2019. There is no allegation of tampering of witnesses alleged against the petitioner. Chargesheet has been submitted in the present case. The petitioner is

Patna High Court CR. MISC. No.31593 of 2019(2) dt.13-05-2019 2/2 not said to be apprehended on the spot. A mini gun factory is alleged to have been running by co-accused Balmiki Yadav. The name of the petitioner has transpired on the basis of disclosure made by co-accued Balmiki Yadav.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 687/2018.
