2. Petitioner apprehends arrest in connection with Mashrakh P.S. Case No. 142/2024 registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2022.
3. Learned counsel for the petitioner submits that the petitioner is innocent and his name is implicated in the instant case on account of dirty village politics. Further submission is that the alleged recovered wine does not belong to the petitioner. Petitioner has no criminal antecedent.
4. Learned APP for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the facts and circumstances of the case
Patna High Court CR. MISC. No.35838 of 2024(2) dt.10-06-2024 2/2 and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond/ bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Exclusive Special Excise Judge, Saran at Chapra in connection with Mashrakh P.S. Case No. 142/2024 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
6. This application stands allowed.
