Petitioner apprehends his arrest in Jakkanpur P.S. Case No.07 of 2019, registered under Section 273 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act.

The police got information that two persons were selling liquor in front of Deepak Fast Food Shop. When the police went there, both persons started fleeing away but on chase one person apprehended. The apprehended accused disclosed his name as Chhotu Kumar and from his possession a bag was recovered in which 5 bottles of Old Monk Rum and 9 bottles of Royal Challenge Classic Premium Whiskey were recovered. The apprehended accused disclosed that liquor was of Pradeep Kumar, the petitioner, who used to give Rs.200/- per

Learned counsel for the petitioner submits that petitioner has got no criminal antecedent. The apprehended accused in order to save himself disclosed the fact that the liquor was of the petitioner. In fact, the apprehended accused was selling liquor.

Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that nothing has been recovered from possession of the petitioner, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.J. Board, Patna City in connection with Jakkanpur P.S. Case No.07 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
