JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-03-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Jamo Bazar P.S. Case No. 78 of 2020 for offences under Sections 304B, 201 and 506/34 of the Indian Penal Code. Petitioner no.1 is father-in-law of the deceased whereas petitioner no. 2 is the brother-in-law of the deceased. Learned counsel appearing on behalf of the petitioners would submit that there is delay of seven days in lodging the first information report and as such, the petitioners deserve anticipatory bail.

Considering the fact that there is allegation of dowry

Patna High Court CR. MISC. No.31139 of 2020(3) dt.22-03-2021 2/2 related torture by the family members of the deceased, this Court is not inclined to grant privilege of anticipatory bail to the petitioners. The prayer for anticipatory bail is rejected. However, in the event the petitioners surrender before the court below and seek regular bail, the court below shall consider and dispose of the same on its own merits on the same day without being prejudiced by the order of rejection of this application.
