The petitioner seeks bail in anticipation of his arrest in connection with Muffasil P. S. Case No. 10 of 2020, dated 10.01.2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 324 and 302 of the Indian Penal Code.

It has been argued on behalf of the petitioner that the act of assault is not specifically attributed to the petitioner. He has been named along with other accused persons, who are said to have assaulted the deceased

The allegation is of crushing the head of the deceased by means of stone by all the accused persons. Considering the nature of accusation against all the accused persons, including the petitioner, I am not inclined to grant anticipatory bail to him.

The prayer for bail of the petitioner is rejected. However, if the petitioner surrenders before the court below and seeks bail, his petition shall be considered on its own merits, without being prejudiced by the fact that the present petition has not been entertained by this Court.
