1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. The petitioner has renewed his prayer for bail in connection with S.T. No. 276 of 2021 arising out of Muffasil Police Station Case No. 148 of 2020 registered under sections 341, 323, 379, 302, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. This Court, vide its order dated 19.01.2024 had called for a report regarding the stage of trial. In pursuance of the direction, letter No. 24, dated 01.02.2024, was submitted, by the Additional District & Sessions Judge-III, Munger, stating therein that out seven charge sheet witnesses, six prosecution witnesses have been examined and cross examined, however, the report says that at this stage, a
Patna High Court CR. MISC. No.39650 of 2023(4) dt.23-02-2024 2/2 petition under Section 311 Cr.P.C. has been filed by the petitioner for recall of four prosecution witnesses for cross examination. The learned Additional Sessions Judge has given estimated time for disposal of trial within three months if both sides cooperate in the trial.
4. Regards being had to the report, I am not inclined to grant bail to the petitioner at this stage, however, the petitioner may renew his prayer for bail after three months if the trial does not progress satisfactorily due to prosecution. (Anil Kumar Sinha, J) HarshPandey/- U T
