JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is in custody in connection with Motipur P.S. Case No.23 of 2020 for offences under Sections 30(a), 41(1)(2) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner would submit that the petitioner has no criminal antecedent. Learned counsel submits that in the instant case, total 33.990 litres of foreign liquor was seized from the house of co-accused Ashok Rai. Petitioner is in custody since 08.06.2020. Considering the period of custody of the petitioner, the Court is inclined to grant bail to him, subject to the condition that the petitioner has to deposit Rs.25,000/- in cash. Case No.23 of 2020.

Deposit of Rs.25,000/- (Rupees twenty five thousand) shall abide by final outcome of Motipur P.S. Case No.23 of 2020.
