2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 380, 384/34 of the Indian Penal Code.
3. It is alleged that this petitioner along with other accused persons stole two buffaloes and calves of the informant. It is further alleged that the F.I.R. named accused persons demanded Rs. One Lakh to return the stolen buffaloes.
4. It is submitted that both parties are co-villagers and due to petty dispute this petitioner has falsely been implicated in the present case. There is inordinate delay of seven days in lodging the F.I.R. and there is no explanation for the same which itself renders this case doubtful. Petitioner has got clean antecedent.
5. Considering the facts and circumstances of the
Patna High Court CR. MISC. No.32491 of 2023(2) dt.25-07-2023 2/2 case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Birpur, Supaul in connection with Birpur P. S. Case No. 60 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
