Petitioner seeks bail in Ishipur (Barahat) P.S. Case No.88 of 2019 registered under Section 376 and other minor sections of the IPC and under Sections 3 and 4 of the POCSO Act corresponding to Special POCSO Case No.99 of 2019. The father of the victim made allegation that the petitioner dragged his minor daughter and committed rape with her in a store room.
Learned counsel for the petitioner submits that the trial has begun and the victim is likely to be examined. The victim has supported the case in her statement recorded under Section 164 of the Cr.P.C.
Taking into consideration the facts and the nature of allegation made against the petitioner and the fact that the
Patna High Court CR. MISC. No.31022 of 2020(2) dt.25-01-2021 2/2 victim is likely to be examined, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
