Mr. Chandra Sen Prasad Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RITESH KUMAR ORAL ORDER 20-07-2026 Heard the learned counsel for the petitioner and the learned A.P.P. appearing on behalf of the State.

2. The petitioner apprehends his arrest in connection with Maheshkhut P.S. Case No.16 of 2026 for allegedly having committed offences under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 308(4), 329(3), 352, 351(2) and 351(3) of B.N.S., 2023 as well as Section 27 of the Arms Act.

As per the prosecution story, which has been lodged on the basis of the written report submitted by the informant, to the effect that on the date of occurrence while she was sitting along with her family members, all the 19 named accused persons, along with 20-25 unknown persons came with arms and started abusing the informant and demanded Rs.2,00,000/- as Rangdari and when the same was refused, all the accused

2/4 persons started throwing stones and bricks. They entered into the house and assaulted the female members of the house and also fired from their arms. It has further been alleged that coaccused, Bhonu Singh fired from his weapon which hit Vikash Mandal on his leg. All the accused persons looted jewellery to the tune of Rs.2,00,000/- and fled away threatening them. The injured was treated at Referral Hospital, Gogri and was further referred for better treatment.

4. The learned counsel for the petitioner submits that no such occurrence has taken place and the First Information Report has been lodged due to previous enmity in between the parties. It is submitted that only general and omnibus allegation against all the accused persons have been levelled, except coaccused, Bhonu Singh, against whom specific allegation of firing at Vikash Mandal has been levelled. It is further submitted that the petitioner was not even present at the place of occurrence and no arms is said to have been seized from the petitioner, since he was not present. It is also submitted that for the same occurrence, aunt of the petitioner namely, Sunita Devi has also filed Maheshkhut P.S. Case No.17 of 2026 under different sections of the B.N.S. and Section 27 of the Arms Act against 33-34 persons of the informant side. It is submitted that

3/4 from perusal of the injury report, which has been brought on record by way of Annexure-P/3 to the present anticipatory bail petition, it would transpire that the injury sustained by Vikash Mandal on his leg has been found to be grievous in nature by the treating doctor, however the same has not been attributed upon the petitioner. The learned counsel for the petitioner further submits that the petitioner has got a clean antecedent.

Per contra, the learned A.P.P. for the State opposes the prayer for grant of anticipatory bail to the petitioner by submitting that the allegation of firing has been made and the injury report corroborates the said allegation, since firearm injury has been found by the treating doctor and the same has been found to be grievous in nature.

Having considered the rival submissions and after going through the records, it appears that 19 persons have been named in the First Information Report and general and omnibus allegation have been levelled against all the accused persons of demanding Rangdari to the tune of Rs.2,00,000/-. It further appears that specific allegation of firing has been levelled against co-accused, Bhonu Singh, due to which the injured Vikash Mandal sustained injury on his leg. The doctor found the injury to be caused by firearm and has also found the same to be

4/4 grievous in nature. Nothing specific has been levelled against the petitioner.

Taking into consideration the facts aforesaid, let the petitioner, above-named, in the event of his arrest or surrender within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Khagaria in connection with Maheshkhut P.S. Case No.16 of 2026, subject to the conditions laid down under Section 482(2) of the B.N.S.S. with a further condition that:- The learned court concerned shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court concerned shall take steps for cancellation of his bail bond. However, the acceptance of bail bond in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
