Petitioner No.2 seeks bail in a case registered for the offences punishable under Section 30(A) of Bihar Prohibition and Excise Act, 2018.
Case diary was called for for hearing on prayer for bail of petitioner No.2-Tej Narayan Rai only. Other two petitioners were already allowed bail.
Allegation is that country made liquor was recovered from a Tempo. Petitioner has got identical criminal antecedent, however, petitioner is in custody since 15.07.2020 and investigation of the case is already complete. Considering the facts of this case aforesaid, let
Patna High Court CR. MISC. No.32559 of 2020(3) dt.05-02-2021 2/2 petitioner No.2, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Excise Case No.958 of 2020 arising out of Sikrahatta Police Station Case No.83 of 2020 with following conditions:
(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
