JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bochahan P.S. Case No. 313 of 2018 registered for the offences punishable under Sections 448, 504, 506, 376 and 511/34 of the Indian Penal Code.

Allegation against the petitioner is that he entered inside the house of the informant and attempted to commit rape upon her and when she raised alarm, he fled away and on the next day other co-accused persons threatened her not to lodge any case.

Submission of learned counsel for the petitioner is that he is the next door neighbour and there is dispute between the parties from before and he has falsely been implicated in this case.

Patna High Court CR. MISC. No.32512 of 2019(2) dt.16-05-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may move for regular bail, which shall be considered on the basis of the materials available on the record. Accordingly, this application is dismissed.
