JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-11-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is in custody in connection with Goraul (Katahara O.P.) P.S. Case No. 179 of 2020 for offences under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing on behalf of the petitioner would submit that the petitioner has no criminal antecedent. The allegation against the petitioner is that the liquor seized was supposed to be delivered to the petitioner. Learned counsel appearing on behalf of the petitioner would submit that there is absolutely no material on record to establish that the petitioner was involved in sale of liquor. Petitioner is in custody since 26.05.2020.

No.30552 of 2020(2) dt.23-11-2020 2/2 Considering the fact that the petitioner has no criminal antecedent and he has remained in custody since 26.05.2020, the Court is inclined to grant bail to him, subject to the condition that the petitioner has to deposit Rs.1,00,000/- in cash. On depositing the amount of Rs.1,00,000/-, the petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.1,00,000/- (Rupees one lakh) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur in connection with Goraul (Katahara O.P.) P.S. Case No. 179 of 2020. Deposit of Rs.1,00,000/- (Rupees one lakh) shall abide by final outcome of the instant criminal case. (Anil Kumar Upadhyay, J) BT/- U T
