JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 31.03.2014 in a case registered for the offences punishable under Sections 302, 201, 379/34 of the Indian Penal Code.
Petitioner is not named in the first information report but in course of investigation, one Pago Mandal disclosed that he had given sim to petitioner and subsequently, the house of petitioner was searched and the mobile phone of the deceased was recovered from possession of wife of the petitioner. Learned counsel for the petitioner submits that as a matter of fact, the aforesaid seized mobile was given to the petitioner by the aforesaid Pago Mandal and except the aforesaid
Patna High Court Cr.Misc. No.27020 of 2014 (4) dt.13-01-2015 material, there is nothing against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Korha P.S. Case No. 294 of 2012.
