JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-02-2023 The present writ petition has been filed seeking the following relief :- "(i) For issuance an appropriate writ in the nature of mandamus to remove the encroachment from the road which is to used by the petitioners from 2009, which is already mentioned in the map as contained in Annexure 3 and which has been encroached by the respondents no. 6 to 8 with the help of respondent no. 5."

At the outset, the learned counsel for the petitioners, in view of the fact that the dispute in question is purely private in nature and is amongst the private parties, seeks liberty on behalf of the petitioners to avail such other alternative remedies, as are otherwise available under the law. Liberty so sought, is granted.
