2. The petitioners have preferred this application for grant of regular bail in connection with Giriyak (Pawapuri) P.S. Case No. 354 of 2023 dated 19.07.2023 registered for the offences punishable u/s 302 read with section 34 of the Indian Penal Code and charge sheet submitted u/s 302, 120B of the IPC.

3. As per the prosecution case, the petitioners and the co-accused persons are alleged to have killed the informant's husband. It is further alleged that the co-accused Munni devi called the informant and informed her that her husband was got admitted to hospital.

4. Learned counsel for the petitioners has submitted that

Patna High Court CR. MISC. No.35238 of 2024(2) dt.16-05-2024 2/2 the petitioners are innocent and have falsely been implicated in this case. There is no eyewitness to alleged occurrence. There is no specific allegation against the petitioners. The mother of the petitioner namely, Munni Devi has informed the informant and she tried to save the deceased. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 25.01.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners abovenamed, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Nalanda at Biharsharif in connection with Giriyak (Pawapuri) P.S. Case No. 354 of 2023.

7. The application stands allowed.
