The learned counsel for the petitioner submits that earlier the bail application of the petitioner was rejected by order dated 10.02.2023 in Cr. Misc. No.40495 of 2022. It is next submitted that liberty was granted to the petitioner to renew his prayer for bail after framing of charge. It is further submitted that the charges against the petitioner stands framed by order dated 05.04.2023 as is evident from Annexure4. The learned Additional P. P. opposes the bail application.

Considering the submission made by the learned counsel for the petitioner, the petitioner, above-named, is

Patna High Court CR. MISC. No.32706 of 2023(2) dt.17-05-2023 2/2 directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-Vth, Saharsa in connection with S.T. No.104 of 2023 arising out of Basnahi P. S. Case No.48 of 2020. The application stands allowed.

However, in the event, if the trial Court comes to a conclusion that petitioner after his release is trying to delay the trial in any manner, the learned trial Court shall be at liberty to forthwith cancel the bail bonds of the petitioner and to take all coercive steps to ensure that petitioner is behind bar.
