The petitioner seeks anticipatory bail in Bihiya P.S. Case No.230 of 2018 instituted for the offences under Sections 341, 342, 323, 368, 368, 374, 354, 120(B) and 34 of the Indian Penal Code and Sections 4 and 8 of the POCSO Act. An information was received by the that the victim girl has been kept under chain and the girl has said that when her father could not return loan amount she was kept under chain and time to time husband of the petitioner used to abuse and misbehave with the victim girl.

In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the

Patna High Court Cr.Misc. No.59077 of 2018 (2) dt.06-10-2018 2 /2 prayer for bail is rejected. However, if the petitioner surrenders before the court below within a period of four weeks from today, the court below will pass an order on its own merit without being prejudiced by the order passed by this Court.
