The petitioner apprehends his arrest in a case registered for the offence under Section 307, 379 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

As per F.I.R., this petitioner assaulted on the head of Santosh Kumar.

It is submitted on behalf of petitioner that the injury is simple in nature. It is further submitted that similarly situated co-accused namely, Dharmendra Kumar, Binod Singh (vide order dated 10.10.2022 passed in Cr.Misc.No. 32077/2022) and Shivam Kumar (vide order dated 10.10.2022 passed in Cr.Misc.No. 32588/2022) have already been granted anticipatory bail by this Court.

Patna High Court CR. MISC. No.32896 of 2022(2) dt.18-10-2022 2/2 Learned counsel for the informant vehemently opposes the prayer for bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria Muffasil P.S. Case No.- 104/2022 corresponding to G.R. No. 311/2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
