The petitioner seeks bail in a case registered under Sections 399, 402, 411, 414 of the Indian Penal Code as well as 25(1-b)a, 26, 35 of the Arms Act and 20/22 of the N.D.P.S. Act. Allegation is that one country made pistol along with five live cartridges are recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.1.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The name of the petitioner has come on the disclosure made by co-accused.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bhagalpur in connection with N.T.P.C. P.S. case No.01 of 2019, N.D.P.S. case No.01 of 2019.
