JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-01-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 379 and other ancillary sections of the Indian Penal Code and sections 25(1-B)a, 26 and 35 of the Arms Act.

One country made loaded country made pistol with magazine having four bullets was recovered from the waist of the petitioner, whereas one revolver with six round bullets was recovered from his bed. A stolen motorcycle has also been recovered from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the

Patna High Court CR. MISC. No.42177 of 2021(3) dt.17-01-2022 2/2 conscious possession of the petitioner. Petitioner is in custody since 19.12.2020.

Considering the aforesaid facts and circumstances of the case and the period of custody of the petitioner, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in Begusarai Mufassil Police Station Case No. 645 of 2020.
