Petitioners apprehend arrest in connection with Complaint Case No. 1291 of 2022 instituted for the offence under sections 323, 392, 307 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioners submits that petitioners have not committed any offence as alleged in the

Patna High Court CR. MISC. No.32648 of 2023(2) dt.14-07-2023 2/2 first information report and they have been falsely implicated in this case due to previous enmity. Petitioners are Assistant Electrical Engineer and Junior Electrical Engineer posted at Electric Supply Division, Itarhi, Buxar and they while performing their duty had conducted a raid with regard to theft of electricity and in that connection Sikraul P.S. Case No. 16 of 2021 (Annexure-3) was lodged. In retaliation of the same, the present false case has been lodged.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Complaint Case No. 1291 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
