The petitioners seek bail in anticipation of their arrest in connection with Warisaliganj P.S. Case No. 242 of 2018 dated 16.07.2018 instituted for the offences under Sections 448, 341, 323, 504, 384, 34 of the Indian Penal Code.

The petitioners and others are alleged to have entered into the house of the informant and demanded

Patna High Court Cr.Misc. No.63477 of 2018(2) dt.12-12-2018 2/3 rupees two lakhs as Rangdari as the informant did not have a son. When this was protested, the informant and his grand-daughter were assaulted by means of knife. The learned counsel for the petitioners has submitted that a false case has been instituted because of pending land dispute between the parties. The informant as well as the petitioners are agnates and neighbours as well. A civil case vide Title Suit No. 28 of 2016 is pending between the parties. The injuries suffered by some of the persons from the side of the prosecution are stated to be simple in nature. The learned counsel for the petitioner, therefore submits that because of the family/land dispute, every now and then quarrel takes place between the parties. It is also submitted that the very story of asking ransom because the informant does not have a son, does not appear to be plausible.

The petitioners do not have any criminal antecedents.

Regard being had to the aforesaid facts, the petitioners, above named, in the event of their arrest or

No.63477 of 2018(2) dt.12-12-2018 3/3 surrender within a period of four weeks from today before the learned Court below, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, II, Nawada in connection with Warisaliganj P.S. Case No. 242 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
