The petitioner apprehends his arrest in connection with Amarpur P.S. Case No. 242 of 2017 registered under Sections 341, 323, 337, 308, 504/34 of the Indian Penal Code. Petitioner is said to have assaulted on the head of the informant by means of khanti.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to dirty village politics. The injury sustained by the informant on his head is skin deep lacerated wound caused by hard and blunt substance. The informant has not sustained any sharp cut injury

Patna High Court Cr.Misc. No.65895 of 2018(2) dt.21-12-2018 2/2 on his head. Moreover, there is no repetition of blow. On the other hand, learned APP opposed the bail prayer of the petitioner.

In the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 242 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
