JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-02-2023 The present writ petition has been filed seeking the following reliefs :- " (i) To direct the respondent authority not to make construction of Park under the Chief Minister urban Development Scheme over the private land of the petitioner, having description Municipal Plot No. 739 appertaining to Khata No. 105, Total area one Katha situated in ward no. 45 (New ward no. 56, Circle no. 85, Thana no. 11 and Tauzi no. 203, located in front of the gate of

Patna High Court CWJC No.16137 of 2013(3) dt.24-02-2023 2/2 T.B. Hospital, near Nalanda Medical College and Hospital.

(ii) To direct the respondents authority to hand over the possession of the said land to the petitioner, as the respondent authorities have illegally occupied the private land of the petitioner besides others.

(iii) To direct the respondent authority to make removal of unauthorized construction and to bring the land of the petitioner to it's original feature."
