JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-03-2020 The present petition has been filed for conducting proper investigation of Digha P.S.Case No. 68 of 2009, pending before the learned court of CJM, Patna Sadar. The learned counsel appearing for the respondents, especially the Investigating Officer, Digha Police Station has filed an interlocutory application bearing I.A. No. 1 of 2020 wherein it has been prayed for extension of time, as granted earlier by this Court for completing the investigation, by a further period of eight weeks.

The learned counsel for the Respondents submits that

Patna High Court CR. WJC No.972 of 2017(5) dt.05-03-2020 2/2 the Respondents undertake to complete the investigation within a period of eight weeks from today and file the final report / charge-sheet before the learned court of C.J.M, Patna Sadar within a period of eight weeks from today.

Having regard to the facts and circumstances of the case as also considering the submissions made by the learned counsel for the respondents, I deem it fit and proper to dispose of the present petition with a direction to the Respondent-Senior Superintendent of Police, Patna to ensure that the investigation of the present case i.e. Digha P.S.Case No. 68 of 2009 is completed within a period of eight weeks from today and the final form / charge-sheet is submitted before the court of learned CJM, Patna Sadar, with a copy marked to the learned Registrar General of this Court.

It is made clear that in case, the timeline provided for in the present order is not adhered to, this Court would consider initiating contempt proceedings against the Senior Superintendent of Police, Patna.

The present petition stands disposed of on the aforesaid terms.
