JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Laxmipur P.S. Case No. 161 of 2017 dated 06.08.2017 instituted for the offences under Sections 376(D), 365/34 of the Indian Penal Code and Section 6 of the Immoral Traffic (Prevention) Act, 1956. The learned counsel for the petitioner has fairly stated before this Court that some other accused persons who are related to the husband of the prosecutrix had come up before this Court for grant of anticipatory bail vide Cr. Misc. No. 49410 of 2018 which was though disposed of vide order dated 29.08.2018 but with a direction to them to

Patna High Court Cr.Misc. No.64115 of 2018(2) dt.14-12-2018 2/2 surrender before the Court below and seek bail which would be decided on its own merits without being prejudiced by the fact that their anticipatory bail petition was not entertained by this Court.

Let the petitioner also surrender before the Court below and pray for bail.

Should such an application be filed before the Court below within a period of four weeks from today, learned Court below shall take into account the peculiar circumstances of this case and pass orders in accordance with law without being prejudiced to the fact that the present anticipatory bail petition has not been entertained by this Court.
