JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 08-05-2019 It is yet another case in which the grievance of the petitioner is that the revision application being Revision Case No. 83 of 2018 preferred by the petitioner before the Commissioner, Magadh Range, Gaya (respondent No. 2) is pending for disposal since 06.06.2018. It is submitted that in terms of Clause 34(vi) of the Bihar Targeted P.D.S. (Control) Order, 2016 the revision application was required to be disposed of within two months.
Learned counsel for the State submits that in the given facts and circumstances of the case the writ application may be disposed of with a direction to the Commissioner, Magadh Range, Gaya (respondent No. 2) to consider and dispose of the application within the statutory period.
Patna High Court CWJC No.9599 of 2019(2) dt.08-05-2019 2/2 In similar circumstances this court has earlier expressed it's displeasure on the manner in which the statutory authorities are sitting over the matters which are required to be disposed of within a time fixed in the statute itself. This is one of those cases in which it appears that the Commissioner, Magadh Range, Gaya, has failed to dispose of the Revision Application within the statutory period.
By way of an indulgence this court directs him to dispose of the Revision Application within a period of 60 days from today after hearing the petitioner and by passing a reasoned order. In case of non-compliance of the order it will be open for the petitioner to move this court in an appropriate application.
