Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner apprehends his arrest in connection with Forest Case no. 02 of 2019 registered under sections 5, 14 of Bihar Saw Mills (Regulation) Act, 1990 and section 41, 42 of Indian Forest Act, 1927 (Bihar Amendment Act), 1989. As per allegation, petitioner was operating saw machine violating the circular as he has no license to operate saw mill. Some woods were also recovered from the place of occurrence.

No.47110 of 2021(2) dt.17-05-2022 2/2 Learned counsel for the petitioner has submitted that wood was for personal use of the petitioner and there was no bar to store the wood for construction of works. He has also submitted that the petitioner is a person of clean antecedents. Considering the above mentioned facts and circumstances, specially clean antecedents of the petitioner, the petitioner above named, in the event of arrest or surrender within four weeks from today, is directed to be released on bail on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in connection with Forest Case no. 02 of 2019 subject to condition as laid down under section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which the matter shall be brought to the notice of this Court.
