This application is filed for grant of regular bail in connection with Jogapatii Police Station Case No. 45 of 2023 registered for the offence under Sections 147, 149, 323, 342, 353, 413, 414, 504, 272 & 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016. Learned counsel for the petitioner submits that there is recovery of five litres of country made liquor and also the petitioner is in custody since 21.03.2023 also the petitioner has one antecedent.

Learned A.P.P. has vehemently opposed the prayer for bail.

Patna High Court CR. MISC. No.33063 of 2023(2) dt.23-05-2023 2/2 Considering the period of custody the petitioner and the nature of allegations levelled against the petitioner, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise, Bettiah, West Champaran, in connection with Yogapatti Police Station Case No. 45 of 2023.

The petitioner will visit Yogapatti Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
