JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 13-09-2018 Learned counsel for the State has received the instruction but has not filed a show cause showing compliance of the order. It is stated that the original appellant Ramjanam Singh has died and an application for substitution has been filed which is pending on the records filed on 06.09.2018. It is because of such developments the appeal is still pending.

Learned counsel for the petitioner is present and submits that he would press the substitution application on the next date and shall ensure his presence on the date fixed in the matter before the Collector so that the order of the learned writ Court would be complied with immediately.

In the aforesaid view of the matter, this contempt application is being disposed off giving liberty to the petitioner

Patna High Court MJC No.3056 of 2016 (3) dt.13-09-2018 2/2 that in case the order of the learned writ Court is not complied with by the Collector, Gaya, within next three months, he will have the liberty to file a short petition bringing this fact to the notice of this Court whereupon the case for contempt would revive.
