The petitioner seeks bail in Koilwar P.S. Case No. 408 of 2020, registered for the offence punishable under Sections 302, 307 and other allied sections of the Indian Penal Code. As per the prosecution case, on the alleged date and time of occurrence, while the informant along with Siya Ram (deceased) was sitting at Community Hall, all the FIR named accused persons including petitioner came there and started abusing and assaulting the informant. On protest, all of them assaulted the informant causing injury to him. Further alleged that other co-accused persons made indiscriminate firing, as a result of which several persons from informant side got injured and Siya Ram died during course of treatment. Patna High Court CR. MISC. No.41685 of 2021(2) dt.25-10-2021 2/2 case and counter case. Specific allegation of firing is against other co-accused persons. There is no allegation of firing against this petitioner. Petitioner is in custody since 09.02.2021 having clean antecedent.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Koilwar P.S. Case No. 408 of 2020.
