The petitioner seeks bail in Danapur P.S. Case No. 34/2019, Special Case No. 381/2019, instituted for offence under Section(s) 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
Learned counsel for the petitioner has submitted that there is no recovery of any illicit liquor from conscious possession of this petitioner.
It is alleged in the written report that on the date of occurrence police received information that in an Alto Car, illicit liquor is being transported. Thereafter the police intercepted a car and apprehended one Kunal Kumar (Driver of the vehicle). On query, he disclosed that he is returning after unloading the
Patna High Court CR. MISC. No.32373 of 2019(2) dt.15-05-2019 2/2 consignment to the petitioner. Thereafter police recovered 121 litres of country made liquor from the house of petitioner. Learned counsel for the petitioner has submitted that seizure-list does not bear signature either of petitioner or any other relative.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna, in connection with Danapur P.S. Case No. 34/2019, Special Case No. 381/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
