JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-12-2018 The petitioner seeks bail in anticipation of his arrest connection with Mohiuddinnagar P.S. Case No. 96 of 2018, dated 16.06.2018, instituted for the offences under Sections 120(B), 143, 144, 145, 147, 148, 153(B), 149, 151, 152, 153, 153(A), 290, 291, 295, 295(A), 298, 307, 324, 326, 338, 332, 333, 337, 341, 342, 353, 427 and 504 of the I.P.C.

It has been submitted on behalf of the petitioner that with respect to the burial of a dead person, a fight took place between the members of two communities leading to loot and arson. Around seventy five persons have been made accused in this case. Though the petitioner has been

Patna High Court Cr.Misc. No.63882 of 2018(2) dt.12-12-2018 2/2 named in the F.I.R., but nothing specific has been alleged against him. It has further been submitted that under similar circumstances, many of the accused persons have been granted anticipatory bail by different Benches of this Court.

Considering the aforesaid facts as also taking into account that the petitioner above named does not have any criminal antecedents, he, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-III, Samastipur in connection with Mohiuddinnagar P.S. Case No. 96 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
