The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code. Petitioner No.2, Laxman Yadav allegedly caused injury at the head of the informant, Pappu Kumar. Submission is that Doctor has found simple injury and there is no allegation of repetition of blow. Considering the fact that Laxman Yadav had knowledge that his act might cause death, I am not inclined to enlarge him on anticipatory bail. Hence, his prayer is refused.

Patna High Court Cr.Misc. No.59912 of 2018(2) dt.05-11-2018 2/2 He may surrender within three weeks and prayer for regular bail.

There is general and omnibus allegation of assault against petitioner No.1, Pankaj Kumar @ Pankaj Kumar Yadav, petitioner No.3, Mukesh Yadav @ Mukesh Kumar Yadav and petitioner No.4, Vikash Yadav @ Vikash Kumar Yadav. Hence, let them, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Banka Police Station Case No.122 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
