The petitioner apprehends arrest in a case registered for the offence punishable under sections 302/201/34 of the Indian Penal Code.

FIR is against unknown for murder of the informant's son.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Informant is not an eye witness of the occurrence and petitioners have been implicated in this case on the basis of statement of Bindi Devi, wife of the deceased. It is next

Patna High Court CR. MISC. No.32609 of 2022(3) dt.05-12-2022 2/2 submitted that as a matter of fact the deceased committed suicide out of anger and similarly situated accused Anil Kumar has already been granted pre arrest bail by this court vide order dated 20.10.2022 passed in Cr. Misc. No. 33519/ 2022. Petitioners have got no criminal antecedent.

Considering the aforesaid facts of the case, prayer for bail of the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let the petitioners mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in Saraiya Police Station Case No. 97 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
