In this case, the petitioner is apprehending his arrest in connection with Simri P.S. Case No. 2 of 2019 registered for offences under sections 272, 273, 120B of the Indian Penal Code and Section 30(a), 38, 41 of the Bihar Prohibition and Excise Act, 2016.

As per allegation made in the First Information Report, 1700.64 liters of illegal liquor have been recovered from the truck bearing no. UP-77AN-3704.

Learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner and has been made accused on the basis of confessional

Patna High Court CR. MISC. No.31466 of 2019(2) dt.13-05-2019 2/2 statement of co-accused. He further submits that the petitioner has got no criminal antecedent.

Looking to the recovery of huge quantity of illegal liquor, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.
