03-01-2022 Heard learned counsel for the parties.

The petitioner seeks bail in Kotwali P.S. Case No. 425 of 2017, registered for the offence under Section 302, 201 of the Indian Penal Code.

On recovery of an unclaimed half-burnt dead-body, F.I.R. was lodged against unknown.

It is submitted on behalf of petitioner that name of petitioner has surfaced in this case on the basis of confessional statement of co-accused Suraj Kumar, who has already been granted bail by this Court, vide order dated 14.03.2018 passed in Cr.Misc. No. 14563 of 2018 (Annexure 2). Except suspicion, there is no substantive evidence against this petitioner. Petitioner is in custody since 31.03.2021.

Learned A.P.P. for the State has opposed the bail petition.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Kotwali P.S. Case No. 425 of 2017.
