JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 12-12-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
Allegedly, it is a case of shot fire upon the informant by the accused persons along with this petitioner. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case and he has clean antecedent.
Learned APP appearing for the State has opposed the prayer for anticipatory bail of the petitioner stating that there is specific allegation of firing against the petitioner due to which
Patna High Court CR. MISC. No.32901 of 2022(3) dt.12-12-2022 2/2 the informant sustained gun shot injury and during investigation, witnesses have also supported the case of the prosecution. From perusal of the injury report, as mentioned at para nos.7 and 8 of the supplementary case diary, there are several penetrating wounds to the informant and the doctor concerned has opined that injuries are grievous in nature caused by projective weapon.
After considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner is rejected.
