JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-09-2018 Heard learned counsels for the petitioners and State. The petitioners being the elder brother and brother's wife of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 304B and 120B of the IPC.

The prosecution case, as per the fardbeyan of Ramanuj Singh is to the effect that the informant's daughter, namely Soni Kumari was married with co-accused Sonu Singh about 1 1⁄2 years prior to the lodging of the present case. Subsequent to the marriage, further demand of dowry of Rs. 3 lacs was made and due to non-fulfillment of the same, the daughter of the informant was killed.

Learned counsel for the petitioners submits that thrust of accusation is against the husband of the victim, who is in

Patna High Court Cr.Misc. No.59668 of 2018(2) dt.28-09-2018 2/2 custody. The petitioners are residing separately from the husband of the victim. It is further submitted that the mother of the husband of the victim, Umapati Devi has been granted privilege of anticipatory bail by a co-ordinate Bench of this Court, vide Cr. Misc. No. 48872 of 2017.

Learned APP submits that the petitioners are named in the FIR.

Considering the thrust of accusation against the husband of the victim and similarly situated co-accused, mother of the husband of the victim has been granted the privilege of anticipatory bail, let the above named petitioners be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned CJM, Jamui, in connection with Jamui P.S. Case No. 402 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
