Learned Counsel for the Municipal Corporation submits that in compliance of order dated 16.06.2025, Mr. Sunil Kumar Pandey, Municipal Commissioner, Municipal Corporation, Chapra, is present in the Court and filed his counter affidavit and explained the situation that mistake is not on the part of Municipal Commissioner; rather due to nonappearance of Counsel for the Municipal Corporation on the

Patna High Court CWJC No.14787 of 2013(9) dt.21-07-2025 2/2 said date, the said order had been passed. Counsel further submits that the submission of Counsel for the petitioner that no payment has been made is not correct; rather benefits under 5th Pay Commission from 01.01.1996 to 30.06.2010 and benefit under 6th Pay Commission from 01.01.2006 onward along with payment of arrears arising out of enhanced salary for the period from 01.01.1996 to 30.06.2010 as well as 1st ACP and 2nd ACP have already been paid much earlier.

3. Learned Counsel for the State submits that the statement of the Counter affidavit is correct.

4. In this view of the matter that grievance of the petitioner has already been settled, the writ petition is disposed off. Personal appearance of Municipal Commissioner, Municipal Corporation, Chapra, is hereby dispensed with. (Dr. Anshuman, J) Mkr./- U
