The petitioner seeks bail in Saharsa P.S. Case No. 108/2019, instituted for offences under Section(s) 341, 447, 384, 379, 504, 506 and 34 of the Indian Penal Code. It is alleged in the written report that on 05.02.2019 at about 4.55 hrs. two boys on a Hero Honda C.D. Plus motorcycle came and demanded petrol of Rs. 500/-. The nozzle man Devnandan Ram filled petrol and when he demanded the price, the boy riding on the driver seat threatened him. He shown allegiance to Anwar Alam, Manjar Alam, Ansar Alam and Sarfaraj Alam of Meer Tola, who had sent him. Later on he threatened to set on fire the Nozzle man. It is further alleged that entire episode was recorded in CCTV and as such the matter

Patna High Court CR. MISC. No.30062 of 2019(3) dt.12-07-2019 2/2 was reported to the SHO, who rushed at the place of occurrence and recovered match box from the pocket of aforesaid boy, who disclosed his name as petitioner.

Learned counsel for the petitioner has submitted that no incriminating article has been recovered from possession of petitioner.

Petitioner is in custody since 05.02.2019 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa, in connection with Saharsa P.S. Case No. 108/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
