2. Heard learned counsel for the petitioner and learned A.P.P. for the State.

3. The petitioner seeks regular bail in connection with Sugauli P.S. Case No. 76 of 2023 dated 19.02.2023, lodged under Sections 394 & 411 of the Indian Penal Code.

4. As per prosecution case, the informant had disclosed that on the evening of 19.02.2023 he was returning to his village from the motorcycle, in the meantime three accused persons chased him by motorcycle and one accused person started assaulting the informant with iron rod, second accused person demanded money on the knife point and third accused person robbed Rs.22,400/-. Subsequently all three went by motorcycle towards Sugauli. With the help of co-villagers who were coming from Tractor, all three persons were apprehended, upon query they have disclosed their name.

5. Learned counsel for the petitioner submits that from the seizure list, it transpires that the recovery of knife took place from the petitioner and the motorcycle has also been recovered. He further submits that antecedent of petitioner is clean, chargesheet has already been submitted in this case and he is in custody since 19.02.2023.

6. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Motihari, East Champaran in connection with Sugauli P.S. Case No.76 of 2023, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

8. With this observation, the bail application stands allowed.
